Summary: | The purpose of this research is to study the crime of sabb (insult) in the sharic
ah law
by examining its concept, types, their respective punishments and to compare it with
the Malaysian law. The research is focused on the opinions of the Muslim jurists in
their classical works on the offence of sabb. The jurists different opinions on sabb
and other related offences and their evidences as well as their approaches in deriving
the rulings are compared and analysed. This research also investigates the crime of
insult and the related crimes as stated by the Malaysian law for the purpose of
comparison. The study found that the punishment for committing insults varies
depending on the types of insults. This research discovered that there are differences
between sharic
ah law and Malaysian law in terms of criminology, types of
punishment and methods of proving. The research asserts the importance of adhering
to sharic
ah law and complying with the regulated laws. In compliance with the spirit
of sharic
ah, the authority is given the prerogative to regulate the laws, which can
secure public interests as long as they do not contradict with the principles of
sharic
ah. |
