| 总结: | This study focuses on Islamic legal stance regarding al-tawarruq, a financial term known before as al-tawarruq al-fiqhi al-fardi i.e. jurisprudential individual tawarruq, as well as al-tawarruq al-masrafi al-munazam i.e. organized banking tawarruq. It explains the concept of financing, its importance, and general stipulations of its legality, with reference to some of its other dimensions. Also, the study expatiates on the fundamental aspects of al-tawarruq, vis-a-vis the perspectives of past and contemporary scholars on it, its foundations, types, and importance. A particular attention is concentrated on both al-tawarruq al-fiqhi al-fardi i.e. jurisprudential individual tawarruq and al-tawarruq al-masrafi al-munazam i.e. organized banking tawarruq by bringing forth divergent opinions among scholars about them. Using inductive and analytical methods, their view-points are analyzed and critiqued with a view to integrating them or preferring the one that is more compatible with the objectives of Shari'ah as regards the preservation of wealth. The study concludes that al-tawarruq is a legitimate financing mechanism which seeks to realize the objectives of Shari'ah concerning the preservation of wealth. However, due to the validity of the view-points of the scholars on the issue, it seems difficult to prefer one view to another. But it is important to adhere to the stipulations and conditions of al-tawarruq al-fiqhi al-fardi i.e. jurisprudential individual tawarruq and al-tawarruq al-masrafi al-munazam i.e. organized banking tawarruq, so that any undue manipulation may be avoided. |
