This study deals with considering the maxims and principles of financial need in that generally and particularly in Islamic cooperative insurance (Takaful). The first chapter will discuss the meaning of maxims (Qawa'id), principles (dawabit) and the difference between them. It also discusses the meaning of need (Hajah) in general and financial need in particular by illustrating its classification and permissibility. The second chapter includes the meaning, fundamental and features of Islamic cooperative insurance (Takaful) and compares it with commercial insurance and social insurance by illustrating its origins, objectives, characteristics, types and its general ruling. The third chapter deals with the consideration of the maxims and principles of need (Hajah) in the permissibility of Islamic cooperative insurance (Takaful) in its types and features. This study adopts the inductive method to gather the texts, scholar's opinions related to the principles and issues on which this study is based on and follows comparative method between them. Moreover, it analyzes the evidences of considering the need (Hajah), its permissibility, principles and its importance to establish Islamic cooperative insurance (Takaful) in its all types and features. The study concludes by establishing the evidences on the permissibility of Islamic cooperative insurance (Takaful) and it's re-insurance by the scholars which is based on some maxims of need (Hajah) among them which are: “the need of people is, it is legal originally in contracts” and “people can invent (contracts) in the field of financial transaction according to their need”. It also includes avoiding risk and uncertainty in the voluntary contracts. Similarly, the study affirms disciplining the Islamic cooperative insurance (Takaful) with the maxims of need (Hajah) to prevent the Islamic cooperative insurance (Takaful) companies and who deal with them from prohibition. | ||
