| 總結: | This study attempts to investigate the issue of organ transplantation in
Malaysian Law as well as in Islamic Jurisprudence. It analyzes the injunctions on
organ transplantation in Malaysian Law and also attempts to examine the status of
organ transplantation in Islamic Jurisprudence relying on the opinions of scholars on
this topic. This comparative study utilizes inductive library method for collecting data
written about the topic on Malaysian Law as well as on Islamic Jurisprudence. Then it
is followed by an analytical study to understand the texts of these two laws. Likewise,
a comparison is made to find out points of agreement and disagreement between
Malaysian law and Islamic law in this regard. The most important findings of the
study are as follows: Organ transplantation is allowed by Malaysian Law, but the
government would have to make some amendments to this law. Muslim scholars are
of different opinions on organ transplantation, and the main point of disagreement is
on the meaning of death. Muslim scholars who agree to organ transplantation impose
some conditions for it to ensure compliance with rulings of the Shari'ah. By
comparing Malaysian Law and Islamic Jurisprudence on organ transplantation we
found that the former is, to a large extent, close to the Islamic stand on the issue. |
