Description
Summary:This research aims to review the provisions of credit card fees in Islamic banks in Malaysia, which are issued by using the model of Ijarah. The study examines the theoretical side of credit card use to clarify the concept of Ujrah, including the general provisions based on the Islamic perspective. The research also points out the relationship between fee (Ujrah) in a credit card transaction in some Islamic banks in Malaysia and the different types of fees charged to the card holders. It also deals with the issue of the determination of fees from the International Visa network and legitimate statement of Islamic Shari'ah opinion in terms of the implementation in Islamic banks. The study focuses on the issue of waiver of the rent or profit in the case of early repayment credit card fees along with the views of Islamic scholars and their discussions on the issues. As for the practical aspect, the concept has been proposed to some Islamic banks in Malaysia for their credit card transactions. The research also focuses on the issue of deal stalled debt which happens in the case of delayed repayment of debt. There is also discussion on the views of contemporary scholars, their relationship in credit card transaction in Islamic banks in Malaysia and the most correct opinion on the issue. The study arrived at a number of results including confirmation the opinion that it is permissible to issue credit cards and charge fees on them. This is the case as long as the credit card issuing bank follows the Shari'ah requirements and its prohibitions such as usury or ilah (legal tricks leading to forms of usury). The results also determine that fixing an amount for a fee is permissible in the cases of need and necessity.
