| 520 | |u This research examined the appointment of women as head of state in the light of both the present political systems and the objectives of Shari'ah. The researcher adopted the inductive approach in collecting academic resources related to objectives of Shari'ah, contemporary framework of presidency, limits of authority in different modem political systems, as well as uncovering the views and arguments of classic and modem jurists about the subject. The analytical approach was also adopted by the researcher in her study of the views of the jurists, their arguments and judgement on the presidency of women. The condemnation approach was used to criticize the views of jurists which were based on ijtihad. The researcher tried to select the better opinion of all and weighting them according to the principle of balancing between interests and evil in the light of the objectives of Shari'ah and the developments in the modem political systems. Also a comparative approach was adopted in comparing between the views and the circumstances of the jurists and the evidences which they have relied upon. The aim of this study is to review the statements and the opinions of jurists about the eligibility of women in assuming the post of president of the state in the light of the objectives of Shari'ah and the reality of the current political systems. The study showed that there is no strong evidence that prevents women from assuming the post of head of state. Moreover the modem political system gives women opportunities and avenues to participate in politics. The issue of gender in the selection of head of state is not the primary criterion for selection, but the test is the ruler's justice, responsibility, honesty and commitment to preserve and achieve the objectives of governance or presidency. |a | ||
