Summary:This study examines the legitimacy of aborting the fetus of a raped woman a study in light of the events in Bosnia and Herzegovina in the ١٩٩٠s. The rape phenomenon has become rampant in the Muslim community due to influence from the Western civilization. There is a big difference between the rape that occurs in peaceful circumstances and that that occurs during war, as the latter is one of the means of psychological war that seeks to destroy the opponent's psyche. Moreover, this goes beyond that to include the fetus which is the result of rape and the question that presents itself is what is the legitimacy of aborting such a fetus? This study finds that the fetus has the right to life, which is guaranteed by Islamic law among the five purposes of Shariah. Rape has an impact on women, children, family and society as a whole. The study shows the number of offenses committed against Bosnian women, which leave bad psychological effects on those raped, their unborn child and their family as well, in addition to the disintegration it causes to the community. The study found that Bosnian women seek different ways to get rid of their unborn fetus that result from rape, by aborting it before or after the soul has been breathed into it. Meanwhile, some are obliged to keep their fetus as they have no other option; however, they suffer a lot from members of the community. The same applies to the child born as a result of rape, whether it is a boy or girl. The study suggests that women who are subjected to rape should not abort the fetus. The study recommends that the community should secure the lives of women and ensure their safety
