| Summary: | This study investigates Maqasid Ijtihad which is rational deduction that observes the objectives of the Shari'ah in deducting rulings, and takes into consideration the application of the rulings in achieving the objectives of the Shari'ah. These comply with the reality in the issues and problems related to the rulings, which are meant to achieve the intended benefits of implementing the rulings. The researcher explains the Maqasid Ijtihad concerning its concept, authoritativeness, fields of study, principles and guidelines and meanings, then attempts to apply the theoritical aspect of understanding in the improtant field of our lives which is the medical field. The researcher emphasizes on pharmaceuticals matters, and the issues of medical treatment whose rapid growth and recent development had been unprecedented in the past. The mujtahid must have enough knowledge and ability in dealing with the benefits and harms in solving complicated problems in the medical field. This is because the mujtahid cannot make a single ruling to the problems, as they are distinctive from one another, however, it is necessary to be seen particularly, also to the degree of interest and harms. The researcher in studying the theoritical aspect as well as the empirical aspect of the topic relies on some methods, especially inductive and analytical, where the former was used in collecting data of terminologies, and then later in analyzing the data. The conclusions point out that Maqasid Ijtihad is a crucial approach in solving complicated issues and problems of today, therefore it should be practiced with regard to its true principles and guidelines of Shari'ah, so that it will not lead to rulings that concern its benefits and advantages solely. The mujtahid also should have expertise in dealing and distinguishing the benefit and harms that overlap each other, as the variance of them maybe obvious and hidden. In this way, man can enjoys development and advancement as they benefit life along with practicing Shari'ah. |
