总结: | This research aims at revealing the relationship between the agreed-upon theoretical doctrines of waqf posed by most Muslim jurists and what the Darussalam Gontor Islamic Boading School has applied for 60 years. It also aims to clarify aspects of both agreement and disagreement of the waqf theory and application, as well as the methodology of waqf adopted by the organization. This kind of issue is fairly interesting inasmuch as Gontor itself is the only educational institution in Indonesia, which has been officially donating to the Muslim world. More interestingly, they not only manage waqf for movable (manqulat) and immovable (ghayr al-manqulat) goods, money (nuqud), benefits (manafi') and rights (huquq), but also for self-person endowments (awqaf dhatiyyah). That is, there are Muslims who intentionally donate for the sake of the interests of the organization. In order to reach the conclusion, the researcher used various ways, including inductive, analytical and comparative methods. The research eventually conludes that the Darussalam Gontor Islamic Boarding School adopts a special definition of waqf, in the sense that it defines waqf as both a permanent and temporary restraint of using material or immaterial wealth for its repeated use, for public or private interests. Through this definition, Gontor makes all types of waqf valid. This is in complete agreement with the basic tenets of Islam, so that they may not be preceded by the statements of any Muslim scholar, such as waqf al-dhat and waqf al-manafi' wa al-ḥuquq. What Gontor does and apply are only to be based on the methodology which concerns the consideration of maslahah. The public interests (masalih) that Gontor seeks are to be based on ijtihad and may contradict the views of the Islamic scholars on the one hand and may agree with them on the other. Nevertheless, what this boarding school has sought is only to develop the Islamic jurisprudence for the purpose of attracting interests (masalih), while not blindly adhering to the opinion of Muslim scholars. |
