| 总结: | This research studies one of the most important forms of modern Islamic contracts, namely the Forward Sale of Usufructs. This kind of contract has been implemented widely among the Islamic Banking Institutions, but it is not applied in the Jumhuria Bank of Libya, prompting the researcher to research and propose to apply it. The significance of this study lies in its underpinning and adaptation of forward sale of usufruct by discussing its concept, conditions and types in the Islamic Jurisprudence, as well as deducting legal rulings for it, presenting legal issues related to it, by examining and incorporating the opinions of scholars pertaining to this matter. The researcher relies on the inductive method by collecting materials from scholars and standard banking practices from Islamic finance institutions around the world. The research concludes that this contract is legitimate among the scholars of four mazhabs, and is widely applied in Islamic banking because of its flexibility and efficiency, and the advantages and benefits it provides to public education, health services, and economic activities which could be achieved through rental or any other legal or conventional economic undertaking. |
