To this end, it aims at explaining the position of Shari'ah on the issue together with how the Islamic Council of Yala deals with such cases and its authority to do so. It follows inductive, analytical and applied methods by collecting data and analyzing them. It derives its data from juristic works, interviews with Council Members and 20 cases disposed by the Council. The study comprises of four chapters. The first chapter includes the research plans and its general structure. The second chapter presents the theoretical meaning of divorce, its types and its legitimacy under Islamic jurisprudence. The third chapter deals with the meaning and connotation of divorce from the perspective of the Islamic Council of Yala, its types, provisions and rules. The fourth chapter discusses the application of the ta'liq bi al-'alaq by the Islamic Council in Yala, including the reasons that have caused divorce and the solutions suggested by the Council. Based on the study, the results show that the main reasons for the occurrence of ta'liq bi al-'alaq; are due to the husband's role including being deficient in fulfilling the rights of the wife, being unjust to co-wives and being involved in the abuse of alcohol and drugs. The study also found that the conditions leading to divorce as stipulated in the certificate of marriage by the Islamic Council of Yala include not supporting the cost of living for the wife, not staying together for four months and using violence against the wife. | ||
