.'oppression, however,' in the present era, the modem technology and means may replace
traditional diplomatic means, which called for the researcher to divide the study into three
chapters: Chapter One: A Study of the general framework of diplomatic privileges and
immunities in the light of the rules of public international law, and Chapter II: The
rehabilitation of the Islamic legal and diplomatic immunity, and Chapter III: The
reflection of technical sophistication on diplomatic immunities. Following this, the
researcher in the study applied analytical approach in order to obtain results as well as
descriptive approach to clarify some of the concepts related to modem diplomacy and
comparative approach because the research deals with the comparison between Islamic
law and international law and the historical method and through the historical perspective
of these immunities and privileges beginning from antiquity to the modem era. The study
found from the recent results that, the most important technical and scientific progress led
to the loss of diplomatic status, and a violation of the rules of diplomatic representation
and immunities enjoyed by the diplomatic agent due to the development of relations
between the countries, and progress in the means of communication and the means of
modem technology, which led to the increasing imbalance in the rules of diplomatic
representation and diminished the role of diplomatic missions. |
