Description
Summary:At one point, Perak was known as the world's largest producer of tin until the time of its price deterioration in 1985. Nevertheless, Perak inherited an abundance of other mineral resources such as iron ore, kaolin, silica, limestone, granite and other mineral which are economically valuable. Therefore, it is the intention of the State Government to revive the industry without compromising environmental sustainability through sustainable mining activities. Ironically, in the current situation, the intention of the State Government is not fully attainable due to a variety of factors especially involving legal constraints. Researching from a legal perspective is deemed significant as there were a lot of applications and approval managed and granted by the State Government which indicates a positive potential in the economic and social development. In the early stage, the methodology of this research is based on exploratory research and experience survey techniques. In extension to that, qualitative method through interviews is found applicable in primer data collection. Some technical and non-technical agencies have been interviewed to obtain a true picture from a legal perspective and an outlook on the industry. At the same time, the information obtained through the reading of legislation involved are analyzed along with data obtained from the relevant agencies. The research analysis is done based on the combination of information from both techniques. As a result, some research findings were obtained from the analysis of various identified factors which one of them is the absence of law coordination among different agencies. Hence the title of this study, namely the implications of the differences in legislation on mining activities in Perak is opted to dismantle the causes of these conditions and propose improvements and solutions that can be submitted to the State Government.
