总结:In this study the researcher attempts to state and explain marital problems in the Maldives, in contrast of Islamic Jurisprudence (Fiqh),with focus on the reasons for the increase of divorce in the Maldives and explaining its literal and technical meanings, its evidences and wisdom of legitimacy. She had also discussed divorce in terms of ban and permission in the light of Islamic Jurisprudence (Fiqh) in comparison with Maldivian Jurisprudence. Also she discussed major reasons for the increase of divorce rate in Maldivian families with indication of a legal solution to tackle this phenomenon. Therefore this study is based on extrapolation method by which texts and sayings of the scholars which are related to the topic is collected and analytical method by which the researcher performed an analytical study on the texts and the sayings of the scholars and Personal Interview with family court judges of Maldives, in comparison with the Maldivian Jurisprudence. Moreover, in dealing marital issues contemporary legislative and judicial systems agreed that (Muthuah) (compensation) of divorce is different from (Nafaqah) (living expenses of the divorced wife on I'dhah period and children's expenses) of divorce, they deserve to obtain Muthuah (compensation) of divorce as well as living expenses during I'dhah(waiting period after a divorce). But arbitrary divorce does not comply Muthuah (compensation) because complying such compensations may consequence difficulties for families. Joint ownership of properties between spouses is recognized in Islamic Jurisprudence, however Maldivian law does not address many of these provisions relating to joint ownership between spouses, and it is left for the court, and the judges.
