| 總結: | This research aims to address the key problems related to the reconciliation of customary marriage of international murder in Southern regions of Afghanistan and to assess such problems from the juridical Islamic perspective. The researcher adopts the inductive approach to compile texts from the Holy Qur'an and Ahadith of the Prophet peace be upon him about the penalty of international murder and the exemption from the death penalty. The researcher also uses the analytical approach through analyzing the Shariah texts relevant to the topic, opinions of jurists on the issue, so as to conclude final rules for the convention of the reconciliation of murder in the tribal cultures and Islamic jurisprudence. The researcher also conducted interviews with some scholars who have experience in issues of customary reconciliation in the Northern region of Afghanistan. The researcher concluded several findings related to reconciliation of intentional murder such as using a free woman as compensation of the same type, for the blood money as to exempt the intentional murderer from the death penalty; and some other findings that are related to marital problems such as the lack of consideration for the pillars and terms of marriage. Also, some of the findings of the research conclude that scholars should strive to solve customary reconciliation of intentional murder problems and dissolve them based on the Shariah objectives related to reconciliation of murder and to use any available means to achieve that such as Shariah and Islamic rules on reconciliation of intentional murder |
