| 总结: | This thesis examines the cultural customs of will and inheritance among Muslims in North West China. It is a very important subject which explains the differences between the customs of Muslims in China and the Islamic law. By understanding the customs and Shari'ah in the proceses of will and inheritance, we know that Islamic law is very tolerant and fair in solving issues related to the matter. In the jurisprudence, we find that the Shari'ah always protects the rights of both the legator and the inheritor so as not suffer from any infringement. This research focused on resolving the conflict between Islamic law and Muslim customs that relate it to the will and inheritance. The research also identified the reasons for the conflict between the customs and Islamic Shari'ah. Some relevant customs related to the will and the inheritance of Muslims in North West China were collected and analysed to see the similarities and differences between the Islamic ways and Muslim ways in North West China. The conclusion provides some practical solutions to the disparity in will and inheritance. |
